1. The Website
The present website www.wisehouse.gr belongs to the non-profit civil partnership under the name “Wise Greece AMKE”, headquartered in Chalandri, 14 Gr. Gyftopoulou & 2A Ath. Diakou Str., PC 15233 (hereinafter the “Organization”). Its objective is to provide support to small producers in Greece to effectively promote their products, while the profit from their sale is used to purchase food, which is then distributed to Orphanages, Soup Kitchens, and Social Groceries across the country.
2. Terms of Use
The operation and use of this Website (hereinafter the “Website”) are governed exclusively by these terms of use (hereinafter the “Terms of Use”).
All web pages hosted on the aforementioned Website of the Organization are subject to these Terms of Use. Websites hosted by other organizations with a different domain (microsites), to which the Organization’s Website may be linked, are not subject to these Terms of Use. Users of such websites must necessarily be informed about the protection policy of the specific websites they visit.
Website users accept the binding nature of these Terms of Use, both regarding the rights and obligations of the Organization and regarding the rights and obligations recognized for the users themselves.
These Terms of Use are fully compatible with current European and Greek law, as well as with Internet transactional ethics (lex internetica). Non-compliance of Website users with these terms entails the responsibility of the users toward the Organization, as well as toward any affected natural or legal persons, in accordance with specific applicable provisions.
Access to and use of the Website – including simple navigation – implies the full and unconditional acceptance by the user of the Terms of Use, as they apply at any given time.
These Terms of Use may be revised and updated at any time and without notice. Users must check the Website for potential changes to the Terms of Use; if they continue to use the Website, it is presumed that they have accepted the amendments to the Terms of Use.
In case the user does not agree with the Terms of Use of the Website, they must refrain from using its services.
The Terms of Use apply to the entire content of the Website (hereinafter “Content”), which – indicatively – includes texts, images, graphics, photographs, designs, illustrations, videos, sounds, files, and software applications.
Except for explicitly stated exceptions (intellectual property rights of third parties, partners, and entities), all content of the Website, and generally all files and data of the Website, constitute the intellectual property of the Organization and are protected according to the relevant provisions of Greek law, particularly Law 2121/1993 (“Copyright, Related Rights and Cultural Matters”), European law, and related international conventions.
3. User Responsibility
Website users must comply with the rules and provisions of Greek, European, and International law and refrain from any illegal or abusive behavior during and in relation to the use of the Website. Website users are liable for any damage caused to the Organization resulting from the improper or illicit use of the Website and the services offered through it.
In the event that the Organization becomes involved in any legal dispute or is called upon to pay any form of compensation due to a breach of user obligations provided for in these Terms of Use, the user shall be obliged to indemnify the Organization for the damage incurred.
The Organization encourages the private use of the Website and its Content for personal information, as well as use for educational or research purposes. For educational or research purposes only, the reproduction or storage of individual pages or data is permitted, provided that their origin from the Website is indicated and the creators’ rights are mentioned (if they appear on the Website), without prejudice in any way to the relevant intellectual and industrial property rights. However, users should be aware that certain files or data may be the intellectual property of third parties (organizations, companies, etc.) and cannot be used without their permission (which may be noted in the relevant indication on the Website).
The storage, reproduction, republication, transmission, or distribution of any part of the Content for commercial purposes or for any other use not falling under Paragraph 3 is strictly prohibited.
The storage, reproduction, republication, transmission, or distribution of registered trademarks of the Organization, as well as trademarks of partner entities appearing on the Website, is strictly prohibited.
Under any circumstances, including negligence, the Organization is not liable for any form of damage or virus infection that the user of the Website’s pages may suffer, who proceeds with such use on their own initiative and with knowledge of these terms.
4. Limitation of Liability of the Organization
The Organization seeks by all means the best possible service for the users of its Website, making every possible effort to ensure that the information and the entire content of the Website are governed by accuracy, correctness, clarity, adequacy, and availability.
However, the Organization cannot guarantee the suitability of the Website’s content for any use, application, or purpose. Under no circumstances, including negligence, shall the Organization be liable for any kind of damage caused to the Website user from such use, which is undertaken on their own initiative and with knowledge of these Terms of Use.
Similarly, the Organization does not guarantee that the Website or any other related site or the servers through which the content of the Website is made available to users are provided without “viruses” or other harmful components.
The Organization bears no responsibility, nor does it guarantee in any case, for the Content, the personal data protection policy, the completeness and quality of services, and the security of other websites interconnected with the Website via “links”, nor for the servers through which the Website and other websites are made available to users.
The Organization is not liable under any circumstances, including negligence, for any consequential, incidental, indirect, or special damages or costs or financial penalties from any third-party claims arising from or in connection with the use, copying, or presentation of this Website or its contents or any other linked website, regardless of whether the Organization had been informed, knew, or should have known of this possibility.
5. Intellectual Property Rights and Trademarks
All content of the Website, except for explicitly stated exceptions (third-party copyrights), is the intellectual property of the Organization and is protected by the relevant provisions of Greek law, European law, and international conventions and treaties.
The Organization reserves all intellectual property rights regarding the content of the Website and the copies created based on it.
Furthermore, the Newsletters that the user of the Website services may receive by registering on the mailing lists constitute the intellectual property of the Organization and are therefore protected by the relevant provisions of Greek legislation and international conventions.
The content of the Website is available to users for personal use and is subject to change without notice at the discretion of the Organization. It may not be transferred by a third party with or without consideration, copied, reproduced, modified, republished, transmitted, or distributed in any way or medium without the written consent of the legal representative of the Organization.
Other products or services mentioned on the electronic pages of this Website that bear the trademarks of respective organizations, companies, partner entities, and any type of private or public legal entity, constitute the intellectual and industrial property of the respective entities, and any use of the content of these websites requires the prior written permission of the respective owner.
6. Minor Users
Website users who are minors are allowed to access the Website services only with the consent of their parents or guardians.
7. Personal Data Protection
This personal data protection statement refers exclusively to the personal data of users which they provide voluntarily and with their consent within the framework of using this Website.
The information provided by users is used for direct and effective communication with the Organization (e.g., information on actions, events, conferences, participation in any competitions and online games, etc.).
The Organization does not distribute to any other organization or partner not associated with the Organization the email addresses or any other information or data concerning its Website users.
The Organization takes all appropriate technical measures to safeguard the personal data of its Website users from loss or any form of illegal processing, as detailed below (see 11. Transaction Security).
Personal data provided by the user to the Organization for any reason, such as participation in events or actions of the Organization, is included in the Organization’s files and used exclusively for their better service and information and is in no way reproduced or made available to third parties. If the user does not wish for their details to be archived, they must inform the Organization in writing within 10 days. In any case, the user retains the right at any time to exercise the rights of access and objection provided by Articles 12 and 13 of Law 2472/1997.
Respecting the principles of personal data protection provided by Greek and European legislation and related international conventions, the Organization will not engage in any unfair use without the user’s prior approval. The Organization in no way discloses, publishes, sells, or exchanges personal details and information entrusted by the user. Exceptionally, personal data may be published by the Organization, always following the procedure provided by law, when required by a Public Authority, Court, etc.
Users can at any time, and if there is a reason, change the personal details they have disclosed to the “Organization” by sending an email to [email protected].
Under any circumstances, including negligence, the Organization is not liable for any form of damage or virus infection that the user of the Website’s pages may suffer, who proceeds with such use on their own initiative and with knowledge of these terms.
A necessary condition for initiating any transaction with the Organization through the Website (e.g., registration for a newsletter, participation in an online event) is the disclosure by the user of certain personal details, such as the user’s full name, residential address, telephone number, and email address.
8. Access to Information
For every donation or other transaction with the Organization (e.g., participation in an online event), the collection of users’ personal details and the issuance of the corresponding legal document is required. The submission of personal data by the user automatically implies their consent to the use of these data for the reasons mentioned above.
The Organization requires its employees and Website maintainers to provide users with the level of security mentioned in this personal data protection statement.
In no other case can the Organization disclose the personal details of its Website users to others without their prior consent, unless required through legal channels.
Under specific conditions, the collection, use, and disclosure of personal data provided electronically is permitted or required by law or based on a court decision without the prior consent of the Website users.
9. Cookies
The Organization has the ability to use Cookies as part of the facilitation and operation of services through its Website. 13. Applicable Law and Other Terms
The Website Terms of Use, as well as any modification or change thereof, are governed and supplemented by Greek law, European Union law, and relevant international treaties.
Any provision of the Terms of Use found to be contrary to the above legal framework or becoming invalid ceases to apply automatically, without affecting the validity of the remaining terms in any case.
This constitutes the entire agreement between the Organization and its Website users and binds them exclusively.
No modification of these Terms of Use will be taken into account or form part of this agreement unless formulated in writing and incorporated into it.
In the event of a dispute regarding these terms of use between a user and the Organization, the former is obliged, before initiating any legal action, to contact the Organization within 15 days by sending an email or other written means. Failure to comply with this term constitutes a breach of a material contractual term concluded between the user and the Organization.
It is hereby explicitly agreed that disputes that may arise from the application of these Terms of Use, if not resolved amicably, shall be governed by Greek law and subject to the jurisdiction of the courts of Athens.
